Terms of service
These terms govern use of the Gatepost service, the SDKs and the console provided by MustGate Labs. Enterprise customers with a signed order form are governed by that order form where it differs.

1. The agreement
By creating an organisation in the console, adding the SDK to an app or otherwise using the service, you agree to these terms on behalf of yourself and the organisation you represent. If you do not have authority to bind that organisation, do not use the service.
2. Accounts and organisations
You are responsible for the accuracy of the information in your account, for keeping credentials confidential and for everything done under your organisation's projects, including by team members you invite. Tell us immediately at security@mustgate.org if you believe an account has been compromised.
3. The service
The service consists of the collectors that accept telemetry, the storage and processing that turn it into metrics and traces, the console, the read API and the SDKs. We may change the service over time, including by adding or removing features, provided that we do not materially reduce its core functionality during a paid term without notice. Changes are announced in the changelog.
4. SDK licence
We grant you a non-exclusive, non-transferable licence to include the SDKs in apps you publish for the purpose of using the service. You may not modify the SDKs except as documented, remove notices, reverse engineer them beyond what applicable law allows, or use them to send data to a service other than Gatepost. SDKs are distributed from authenticated repositories; the credentials are confidential and for use by your organisation only.
5. Acceptable use
You must not use the service to store personal data of end users beyond what the SDK collects by design, to monitor apps you do not have the right to monitor, to probe or overload the collectors or the console, to circumvent plan limits, or in violation of applicable law. You are responsible for your apps' compliance with app store rules and with the privacy obligations you owe to your users, including any disclosures about performance monitoring.
6. Customer data
Telemetry sent by your apps and the configuration you create are your data. We process them only to provide the service, as described in the privacy policy and, where signed, the data processing agreement. You grant us the right to process them for that purpose and to produce aggregated statistics that do not identify you or your users. On termination you can export your data for 30 days, after which it is deleted.
7. Fees and payment
Plan fees are listed on the pricing page and charged monthly or annually in advance; usage above the included sessions is charged at the end of each month. Prices exclude taxes, which are added where required. Invoices are due within 14 days. If a payment fails we notify you and retry; after 21 days without payment we may suspend ingest for the organisation until the balance is settled. We may change prices with 30 days' notice; changes take effect at your next renewal.
8. Availability and support
We aim for 99.9% monthly availability of ingest and the console, measured as described on the status page. Business and Enterprise plans include service credits for months below that target, as set out in the plan description or order form. Support is provided by email at the response times listed for your plan; response times are measured in business hours in the Central European time zone.
9. Intellectual property
The service, SDKs, documentation and the Gatepost name and logo belong to MustGate Labs and its licensors. Feedback you give us may be used without obligation. Nothing in these terms transfers ownership of your apps, your data or your trademarks to us, and we will not name you as a customer publicly without your written permission.
10. Warranties and liability
We warrant that the service will perform materially as documented and that we will process your data in accordance with the privacy policy. Otherwise the service is provided as is, and we disclaim implied warranties to the extent permitted by law. Neither party is liable for indirect or consequential loss. Our total liability under these terms in any twelve-month period is limited to the fees you paid in that period, except for liability that cannot be limited by law, for breach of confidentiality or for our data protection obligations.
11. Term and termination
These terms apply for as long as you have an organisation in the console. You may delete your organisation at any time; paid terms are not refunded except where required by law. We may terminate or suspend for material breach that is not cured within 14 days of notice, or immediately if your use threatens the security or integrity of the service. Sections 6, 9, 10 and 12 survive termination.
12. General
These terms, the privacy policy and any signed order form or data processing agreement are the whole agreement between us. If a provision is unenforceable the rest remains in effect. Neither party may assign the agreement without consent, except to a successor of its business. The agreement is governed by the law stated in your order form or, for self-service plans, the law of the jurisdiction in which MustGate Labs is registered as identified on your invoice, and disputes are resolved by the courts there. We may update these terms with 14 days' notice by email to organisation owners; continued use after the effective date is acceptance.
